Terms of Use

These Terms govern access to and use of the Golf Syndicate platform (Platform).

By accessing or using the Platform, the User:

• acknowledges that they have read and understood these Terms;
• agrees to be bound by these Terms; and
• enters into a legally binding agreement with Golf Syndicate.

If the User does not agree to these Terms, the User must immediately cease using the Platform.

The Platform is operated by Golf Syndicate in Australia.

References to “Golf Syndicate”, “we”, “our” or “us” are to the platform operator.

The Platform is a digital membership, marketing and promotional platform.

The User acknowledges and agrees that:

• the Platform facilitates access to third-party products, services and promotional campaigns;
• Golf Syndicate does not supply third-party goods or services;
• Golf Syndicate does not conduct prize draws or gambling activities;
• promotional campaigns are conducted by independent third-party promoters or draw providers; and
• Golf Syndicate does not control or influence campaign outcomes.

The User must not access or use the Platform unless they:

• are at least 18 years of age;
• have the legal capacity to enter into binding agreements; and
• comply with all applicable laws.

Certain features require account registration.

The User must:

• provide accurate and complete information;
• maintain the confidentiality of login credentials; and
• notify Golf Syndicate of any unauthorised access.

The User acknowledges and agrees that:

• they are solely responsible for all activity on their account; and
• Golf Syndicate is not liable for unauthorised access.

Golf Syndicate may, at its absolute discretion, suspend, restrict or terminate any account.

The Platform may provide subscription-based membership services.

The User acknowledges and agrees that:

• membership provides access to platform features and benefits only;
• membership fees do not constitute payment for lottery entries; and
• Golf Syndicate may modify or withdraw membership features at its absolute discretion.

The Platform may display promotional campaigns.

The User acknowledges and agrees that:

• all campaigns are conducted by independent third parties;
• Golf Syndicate does not conduct or control prize draws;
• eligibility is determined by Golf Syndicate systems; and
• participation does not guarantee any outcome.

Each campaign includes a free entry method.

The User acknowledges and agrees that:

• free entry is subject to strict compliance with entry requirements;
• Golf Syndicate may determine entry validity at its absolute discretion; and
• non-compliant entries may be excluded.

The Platform may provide access to third-party services, including partners and external websites.

The User acknowledges and agrees that:

• all third-party interactions are solely between the User and the third party;
• Golf Syndicate is not responsible for third-party conduct, services or products; and
• use of third-party services is at the User’s own risk.

The Platform is provided on an “as is” and “as available” basis.

The User acknowledges and agrees that:

• Golf Syndicate does not guarantee uninterrupted or error-free operation;
• the Platform may be unavailable, modified or withdrawn at any time; and
• technical errors or system failures may occur.

The User must not:

• engage in fraudulent or deceptive conduct;
• create multiple accounts;
• attempt to manipulate campaigns or platform systems;
• misuse referral systems or promotional offers; or
• interfere with the operation or security of the Platform.

Golf Syndicate may, at its absolute discretion, suspend or terminate access for any breach.

All Platform content is owned by Golf Syndicate or its licensors.

The User must not reproduce, distribute or exploit any content without prior written consent.

The User acknowledges and agrees that:

• all determinations relating to eligibility, allocations, membership status and referrals are made solely by Golf Syndicate systems;
• such records are final and binding; and
• technical limitations may affect system outputs.

The User acknowledges and agrees that they have not relied on any representation, statement or promise not expressly set out in these Terms.

To the maximum extent permitted by law, Golf Syndicate excludes all liability for any Loss arising out of or in connection with:

• use of the Platform;
• participation in campaigns;
• third-party services or transactions;
• system errors or technical failures; or
• inaccurate or incomplete information.

Nothing in these Terms excludes rights under Australian Consumer Law.

The User indemnifies Golf Syndicate against any Loss arising out of or in connection with:

• breach of these Terms;
• misuse of the Platform; or
• unlawful or negligent conduct.

Golf Syndicate may, at its absolute discretion:

• suspend or terminate access to the Platform;
• restrict functionality; or
• remove content or accounts.

The User acknowledges that Golf Syndicate is not liable for any Loss arising from such actions.

Golf Syndicate may amend these Terms at any time.

Continued use of the Platform constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Australia.
